After April 2015’s near disaster of an uncontrolled gas well by Lake Arlington Baptist Church, the Environment Defense Fund came to our good city’s aid with this letter asking that a lawsuit against our city be dropped. Read the letter here.
Here is a TIPRO link called “Oil and Gas Industry Disappointed with New Fire Code Tax in City of Arlington – New Unconstitutional Fire Code Tax Results in Lawsuit”. Tipro went on to say…“The City of Arlington already imposes the highest fees for oil and natural gas operations in North Texas. Operators paid $1.8 million in city fees in 2011 alone and the City received $2.5 million in mineral ad valorem revenues. And the City of Arlington received an additional $105 million in bonuses and royalties over a five years period ending in 2011,” said Hastings
AHHH the money …make sure you at least read the last line of this blog for the real issue.
U know U R from Arlington when the frackers sue the city cause we singled out Urban Drilling and tried to collect fees ($2,400 per well) to fund our
...oh wanh’…. Special Use Permits/Drilling Zones are uniquely allowed in every zoning type in our good city so HELL YEAH we singled thar’ arses’ out!
Imagine that…Arlington caring about public safety? Now that’s a side swipe idea that Ida never thunk….or was it just a pure money grab as described in the link below?….
Prior to the need for these emergency preparedness dollars….. our Special Use Permits were signed off ASSuming all is good… as is….“All the regulations provided in this ordinance are hearby declared to be governmental and for the health, safety and welfare of the general public.”
And notice below on number 6 how the indemnity continues to not hold any of our dear city council, mayor, or city employees responsible either!!!
And even prior to getting the special use permit approved by the city, the “frackers” have to sign this indemnity form (which I think is enough evidence to get the city off the hook in this lawsuit-but hey I’m no lawyer)…
And what infuriates me MOST is how even after we were taken to court and have YET to collect these fees, that the city still continues to permit more gas wells not knowing if we’ll ever collect these “needed” fees.
As stated by our former Mayor Cluck in that petition, “We can either tax the taxpayers or put on a fee for the drilling companies and to us it was more fair for them [gas companies] to pay for it since they’re doing the drilling and creating the need for additional training.”
So if we lose this lawsuit will this result in higher taxes for the citizens then in paying for this ER gas well response program?
In closing, whats kinda special in reading this legal petition is that I may have been the one to have sent our Fire Chief this C H E S A P E A K E video that the oil & gas associations say he references as an example of of why our city needs the fees from the frackers….
The reason I think I sent him this video is that I commented on it three years ago and that real threat has yet to be addressed….
